A woman in her thirties has received a prison sentence after falsely accusing her biological father, who had financially supported her education abroad, of rape because he declined to give her more money.
The legal community revealed on the 1st that the Criminal Division 1 of the Namyangju Branch of the Uijeongbu District Court, under the presiding Judge Choi Chi-bong, has handed down a 10-month prison sentence to the woman, known as A, on charges that include defamation, business obstruction, and insult.

A was taken to court for posting defamatory content about her father, B, on an online forum 11 times between May and June of the previous year, with titles like "I am a victim of familial sexual violence. Please look at this."
In these posts, she falsely asserted, "I have been continuously sexually assaulted by my biological father since I was four years old, and my mother also suffered domestic and sexual violence," and claimed, "The issue was resolved with 30 million won as damages," and "Severe punishment is necessary."
During her postings, A disclosed B's real name and business details, which reportedly caused B difficulties in maintaining his business operations.
Moreover, A is accused of making six posts alleging that B married a woman, C, with whom he had been unfaithful.

In February 2021, A initiated a sexual assault-related damages lawsuit against B in the Incheon District Court but was unable to produce evidence of any unlawful activities.
In the criminal proceedings, A maintained that her allegations were true, but the court rejected her assertions, referring to the lawsuit’s conclusion. It noted the absence of specific evidence or scenarios supporting A's claims of habitual sexual assault by B.
Moreover, the court found it plausible to interpret A's claims as false, given that B had financially supported her during and after her studies abroad, and she accused him of rape shortly after he refused her a large sum for a café venture.

The court stressed, "She disseminated false information about the victims out of resentment over being denied financial assistance. The reputations of the victims have suffered irreparable damage."
The court elaborated on its reasoning for the sentence, noting, "Considering the significant risk of reoffending, as evidenced by her continued similar postings after the crime, and the victims’ strong demand for harsh punishment, these elements were thoroughly evaluated."
